The South Australian position

The Surveillance Devices Act 2016 governs listening, optical, tracking and data surveillance devices in this state, and it takes a broadly restrictive approach with defined exceptions.

Recording conversations. South Australia generally requires consent. There is an exception where the use of a listening device is reasonably necessary to protect a person’s lawful interests, which is real but narrower than most people hope. It is not a general licence to record anyone you are in dispute with.

Use and publication. The Act separately restricts communicating or publishing information obtained through a surveillance device, including where the recording itself was lawful. This trips people up constantly. Making a recording and sending it to somebody are two different legal questions.

Tracking devices. Using a tracking device to determine the location of a vehicle or person without consent is an offence.

Optical surveillance. Regulated, with exceptions for premises you occupy and for protection of lawful interests.
