The ACT position, and the border problem

Recording conversations. Under the Listening Devices Act 1992 (ACT), a person who is a party to a private conversation may generally record it. New South Wales, which begins a short drive in every direction, generally requires everyone’s consent.

That difference is the single most important thing for a Canberra reader. A conversation recorded lawfully in Civic may not have been lawful had it happened in Queanbeyan. If the parties are in different jurisdictions, or the conversation crosses the border, the position gets complicated quickly and is worth advice rather than assumption.

Conversations you are not part of. Prohibited, as everywhere.

Workplace surveillance. The ACT has dedicated legislation in the Workplace Privacy Act 2011, which requires notification before surveillance of workers, a policy, and consultation. Covert surveillance requires authority. Given the concentration of public sector and contracted employers in Canberra, this is the provision most likely to be relevant to a local business, and it is enforced.
