The Tasmanian position

Recording conversations. Under the Listening Devices Act 1991 (Tas), recording a private conversation generally requires the consent of all the parties to it, including where you are one of them. Tasmania sits with New South Wales, Western Australia and South Australia on this, not with Victoria and Queensland. Limited exceptions apply, including where a recording is reasonably necessary to protect a lawful interest.

Short stay and holiday property, the Tasmanian issue

Tasmania has an unusually high proportion of short stay and holiday accommodation, and it produces the enquiry we get most often from this state: can I put a camera in a property I own but rent out to guests?

The short answer is that cameras inside a property occupied by paying guests are a serious problem. A guest in short stay accommodation has a reasonable expectation of privacy in the interior, and recording them without their knowledge exposes the owner to criminal liability as well as to platform bans and civil claims. Bedrooms and bathrooms are never acceptable in any circumstance.

Exterior cameras covering entrances and driveways, disclosed in the listing and visible on arrival, are the version that is defensible. If your concern is damage or unauthorised parties, that is the direction to go, along with noise monitoring devices that do not record audio.
