Victoria is different, and it matters

The single most useful thing a Melbourne reader can know is that Victoria treats recording differently to New South Wales.

Under the Surveillance Devices Act 1999 (Vic), a person who is a party to a private conversation may generally record that conversation without telling the other people in it. New South Wales, Western Australia, South Australia and Tasmania generally require everyone’s consent. Victoria, along with Queensland, the Northern Territory and the ACT, does not.

This is why so much conflicting advice circulates online. Most of it is written for a different state.

Two important qualifications. First, this only applies where you are genuinely part of the conversation. Leaving a recorder in a room to capture a discussion you are not in remains an offence in Victoria as it is everywhere. Second, making a recording lawfully and then using or publishing it are different questions, and the Act restricts communication and publication separately.

Tracking devices are also regulated in Victoria. Installing one on a vehicle without the consent of the person in lawful control of it is an offence.
