Western Australia has distances the eastern states do not, and assets spend a lot of time a long way from anyone watching them. Plant and equipment on remote sites, light vehicles running between town and operation, trailers, generators, light towers and attachments that walk off a yard and are three hundred kilometres away before anyone notices.

Battery powered magnetic trackers suit this well. No wiring, no auto electrician, four weeks between charges, geofence alerts when an asset leaves an area it should not, and a live position to hand to police rather than a description and a plate number.

The second common purchase is premises security for businesses and homes where a visible camera has already been defeated once.

The Western Australian position

Western Australia is one of the stricter jurisdictions, and Perth buyers coming off advice written for Queensland or Victoria are frequently caught out.

Recording conversations. Under the Surveillance Devices Act 1998 (WA), recording a private conversation generally requires the consent of all the principal parties, even where you are part of the conversation yourself. This is the opposite of the Victorian and Queensland position. There are limited exceptions, including where a recording is reasonably necessary to protect a lawful interest.

Tracking devices. Using a tracking device to determine the location of a person or an object without consent is an offence. Your own vehicles and plant are fine. A vehicle in somebody else’s control is not.

Optical surveillance. Recording private activity without consent is regulated, with exceptions.

Publication. Communicating or publishing material obtained from a surveillance device is restricted separately.
