What Sydney customers buy most

The New South Wales position

Three separate pieces of legislation apply and they cover different things.

The Surveillance Devices Act 2007 governs listening devices, optical devices and tracking devices generally. Recording a private conversation you are not part of is an offence. So is tracking a vehicle without the consent of the person in lawful control of it.

The Workplace Surveillance Act 2005 governs employers. Camera, computer and tracking surveillance of employees requires fourteen days written notice and a policy. Covert workplace surveillance requires a magistrate’s authority.

The Telecommunications (Interception and Access) Act 1979 is federal and covers interception of calls and messages in transit.
